It seems possible that they could, but who knows. There might be fears that if books were only released that way, there could be indefinite copyright so the Court may be more sensitive to restrictions on express than on utilitarian items like software. That's just a guess.

The thought of applying this to books and music is sickening. Lets protect our buck at the expense of knowledge and culture availability to the public. SO many people get used books online and enrich the general level of knowledge in the world. And we're talking about knowledge here, not just consumable entertainment.

By all means, make the cost of attaining knowledge and culture more! Thieves! We own it!

What about libraries?

The US, and nearly all countries, are not nations. They are corporations. You see the name of a country in bold on your passport? It's not a country, it's a company, as only company's names are in bold. Countries names are not in bold, only the first letters are in bold. If you look on companies house (uk thing) you will find all our political parties and police forces registered as limited companies

Well, since I am only a PC gamer it has been this way for years. The last PC game I was able to sell was TES: Oblivion. Nothing new...the way I see it this just makes it fair across the board with PC and console gamers.

Though I don't see this stopping much. Ebay might have to ban the selling of used games, but craigslist and the like won't give a darn. This might make GameStop go out of business though. I have a feeling a very large chunk of their revenue comes from pre-owned games.

I don't see this moving to movies or anything...Ebay type sales are the only source of pre-owned movies I can think of besides a pawn shop. Hollywood probably doesn't care about that since that would likely effect the rental market more than actual sales.

To add futher complexity.... what about eBooks?

I assume this and online music fall under software?

As more and more media becomes digitized and electronically distributed.... Is it safe to say that First Sale doctrine is going to apply to less and less.

Honestly.. most of this case is pointless. If you try to sell your copy of Photoshop or an Autodesk software, the person buying it won't even be able to use it because the license has already been used.. And I imagine the same would go for some PC games. The only people I see who can really profit from this and I personally truly believe they really need this, are the Video game Companies. Gamestop makes a KILLING off used game sales, they can sell a single disk any number of times and greatly profit. I believe the game companies will just ask for a little cut in they're sales rather then abolish it completely... because by doing so Gamestop would definitely go out of business and that's they're biggest retailer.
