on cinebench 10.5 this was certainly the case as cinebecnh uses the ICC. I can't speak for the new cinebench 11.x something, but you might want to look up Agner and intel compiler on google for more info.

Yep

AVX isn't allowed on anything but Intel

SSSE3/SSE4.1/4.2 require special codes to allow those instructions to run on VIA/AMD CPUs

The only proprietary compiler that allows AVX is the Microsoft one and it does it faster than the Intel version as well

The only thing required is the genuineintel cpuid if the binary is built with the Intel compiler. Intel has every right to make sure the compiler they sell is optimized for Intel cpu's. they just need to be forthcoming about it.

They are forthcoming about it there is a note where you download the compiler it says

"Our compiler hates CPUs made by other corporations this is our only warning if you miss this expect people to hate on you if they use CPUs from other corporations"

GCC has less optimized clib library's in general, but it does not discriminate cpu brand, it simply checks for flags to allow for code paths. I doubt its a big difference. I hear the Microsoft compiler is the cats meow though.
