Okay I have actually talked to Evga about this and here is there take coming from a warranty specialist. If the Card is bought Brand new from a 3rd Party, Ebay, Classified, Craiglist, friend and or other non retailer EVGA will not honor there warranty and considered it void regardless if its unopend brand new, and unopened.
Now you can go to there site and register the card no problem as some sellers will say but if your card pops and you have to do an RMA, than they will ask for Proof of purchase and if you cannot give them one or show an ebay invoice they will void the warranty. Now I have been told if it's a Authrozied dealer on ebay (Example tigerdirect, and any other retailer) they will honor the warranty.
But I stress if you buy it from a person on the forms, ebay or other 3rd party only the original buyer can have the card warrantied as long as they have proof of purchase form an authrozied seller.
Hope this helps I had this same question and I actually called EVGA and asked them also here is a quote from there warranty."Products sent in for RMA will be repaired or replaced with a product of equal or greater performance if an exact replacement is not available.
EVGA requires an invoice or receipt as proof of purchase to take advantage of any warranty related services necessary.
