This.

I'm sorry Apple, but there are only so many different ways that a tablet can be designed. They may or may not have buttons on the bezel or along the sides. In Apples case, they choose to go with a design with a button (circular dimple) in the bottom center of the bezel.
Anyone else that creates a tablet with a button (circular dimple) in that particular spot and of the same approximate size of the iPad would be infringing on their rights.
Samsung's Galaxy Tab does not have that button placed there, and although similar in shape without the button in the bottom center, does not infringe on the protected design of the iPad.

Maybe someone needs their brain checked? It's like saying natural born twin girls look different because one has long hair and the other has her hair tied up.

LoL, that's the problem with people like you and Samsung. Lack of innovation and the lack of drive to be different.

Acer's Iconia, HTC Flyer, ASUS Eee Slate, ARCHOS 101, Toshiba Thrive, Fujitsu Stylistic Q550 and a ton others look nothing like the iPad.

Samsung had it coming for them. In case you didn't know Koreans are notorious for copying in Asia.

Walk into a Korean supermarket and it looks and feels exactly like a Japanese supermarket, yeah coincidence.

TBH...I think the judge has proved nothing.

Hold them up in front of me, and I couldn't tell you either.

I couldn't tell you an iPhone from a from a Galaxy II S either, if you cover up the brand.

If the lawyer isn't familiar with the look, then it proves nothing other than they are ignorant of the product line they represent.

I thought an attorney's job was to represent Samsung legally...not aesthetically.

I guess Samsung needs to hire more blind attorneys to win cases?

If the judge was holding the tablets with her finger covering the area wwhere the button is, could you tell?

And if the screens were off, it would be very hard from 10 feet away to see the thinner border.

But still, just because 2 products look similar (I mean come on, it is a flat black piece of plastic) does not mean one will compete with the other.

I will go take a crap and patent that shape, and anyone else that makes a similar piece of crap will get sued.

Clearly this proves one of them completely stole from another's design!!

EDIT: in fact, are those even TV's?.......OR ARE THEY SAMSUNG GALAXY TABS?!?!

Well, in all fairness, lawyers aren't necessarily (and generally aren't expected to be) expert witnesses on a subject. Familiarity with either or both tablets is derived from personal use--if they didn't have any personal usage experience with them, there's no reason to be able to identify either.

That being said...

Whomever that lawyer is, I imagine their reign with Samsung will soon be over...I'm not a lawyer, but i imagine a proper response to that questioning should have first been been, "it's not relevant to distinguish products from an unusable distance away," and left it at that. If the judge wanted a better answer, then you can push it. But to give away your hand so easily, that's a monumental failure. Or say something like, "my eyesight isn't very good at that distance..." Something constructive...

Quote:
Koh also tentatively said she would not grant Apple an injunction based on one "utility" patent the company has accused Samsung of infringing upon. She has not given an opinion on three-other design-related patents, but promised a formal order will come "fairly promptly."
Again, all of this just points out the failing of the patent system--if things come down to such a subjective analysis, then there is a ginormous problem with the system currently used.
