[AI] Samsung lawyer couldn't tell iPad and Galaxy Tab apart from 10 feet away - Page 21

But if you're their attorney being paid exuberant amounts of money to protect your client...SURELY you'd be able to tell a 16:12 tablet from a 16:10 tablet. No matter what distance you're at, those rectangles have different aspect ratios. Seeing as how that's ones of the few things on your mind during the weeks/months of the trial, you should really have your crap together.

I'm against Apple in this case purely because it'll hurt competition however I don't think that they're necessarily wrong here. I believe Samsung has copied both the iPad and its packaging.

Prior to the iPad there were plenty of tablets, but none that had the simplistic and clean design that the iPad does (correct me if I'm wrong). There are big similarities between the iPad and the Tab, for example, the width of the borders on the Tab are almost identical to those on the iPad, and it has the same metal border that the iPad has as well.

You might say that's only two things but that's really all that makes up the iPad. But many previous slates weren't like this. Samsung could've at least differentiated it a little bit, perhaps use a black border instead? Maybe make the bevel a bit less.

They've also copied Apple's simple yet clean and elegant packaging. And I'm with Apple on that one.
How can you patent a "simple" and "elegant" design? Its a stupid case because there are enough cues to differentiate the two products...dumb lawyer by the way

The iPad "design" was an obvious next step as tech allowed.

The thing about the iPad is its simplicity, which makes it non-distinctive. If they made it have a distinctive design, THEN I would agree that it should be trademarkable. Its like trying to trademark the shape of a tire in its simplest form... the design follows the function, not the other way around (we can use a drag radial, as that is a much more simple design and it can basically ONLY be one certain design because of its function).
They were thicker but also had buttons and designs on the front of them. I see where you're coming from but I'd actually argue that the simplicity makes it distinctive because there's been no slate before it that is that plain. It's Apple's style, if you will.

Samsung isn't going to make some oddly shaped box for something as simple as a thin squared tablet. The iPad box is white, the Galaxy box is black, though there are different variants since different providers sell it and in different countries as well. I guess I could side with you there if there is a white one with very similar images and text design.

You shouldn't be able to patent a design like the iPad. But competitors should at least try to differentiate their product (on the front).

Apples packaging claim is complete crap, I've got a box for a Motorola V3 (Before iPhone at least) and while the outside isn't as simple as the Apple product, nearly everything else fits.

That box is nothing like the iPhone's packaging. I'm not talking about the points made in the article, rather look at the actual packaging Samsung is using and tell me in all honesty that you don't believe, despite them using completely different packaging before the iPhone, that in anyway they copied Apple's packaging.

It's IDENTICAL. But it looked nothing like it does now before the iPhone. Not only the way they package the phone, but the slate as well! It couldn't be any more blatant.

If I were apple I'd be completely flattered by Samsung copying me in any way. Samsung is a big company, and if they are copying you you know you doin' somethin' right.

and then I'd think, maybe this isn't such a bad thing... maybe it will prevent my awesome Ipad from falling into the hands of a d-bag... Let the d-bags that can't tell the difference buy the Samsungs tablet!

If I were apple that is...

I don't even own a tablet because though, guess I'm just not trendy enough.

qft

It's like PC monitors
a good majority of them look almost exactly the same
but as long as there is a logo or branding somewhere on it, there is no issue.
Apple didn't invent the rectangle, nor did they invent putting a screen inside a rectangle. Patent system is so dumb.
