what are we doing by arguing between ourselves?

Apple is using this patent in their case, claiming that they own sole rights to their design.

Good pointing that out and rep to you sir! Does anyone know if HP's tablet pc has gotten sued by Apple before patent infringement?

Thats doubtful as it's actually named in the US design patent for the ipad.

It's IDENTICAL. But it looked nothing like it does now before the iPhone. Not only the way they package the phone, but the slate as well! It couldn't be any more blatant.
If I recall correctly, one of the things Apple said (Apart from the picture on the box) was that the phone "is held in a cradle, so as to be immediately presented to the user when they open the box."

Both the Motorola V3 and V3xx did this before the iPhone, the first iteration I saw of Apples box design was my iPod Classic I had from November 2007.

You might think Apple shouldn't be allowed to sue for something like this, however you can't deny that Samsung has copied Apple.
How is it different in any way apart from shape? Apple only specified that its a cradle holding the product, not that its a rectangle made of matte plastic that hugs the phone/iPod/whatever.

Then again having to similar things that are obviously different when you know where to look is nothing new. For proof just Google Chevy Nova and Plymouth Duster and compare most of those images. Having a lawyer get confused from 10 feet is irrelevant. Especially if the judge covered the button on the iPad.
Are you serious? I could tell the difference straight away, the Nexus Prime is more rounded and the Galaxy S II is bigger and has the square home button.

If this isn't enough to show you that Apple design is hardly innovative I don't know what is.

After the ipad was already well rumored and being made into a shipping product... MS says oh, here's some vaporware.

Cap Chaos, why don't you tell me where those products are on the market???
Uh and yes they are after the iPad... since they ipad was announced on jan 27th and actually existed.

In what world do you live in where January 7th, 2010 (CES Slate announcement) comes after January 27th, 2010 (iPad announcement)?

Whether or not they were released is irrelevant. The design is hardly Apples to claim is what the point is. Similar designs were around before the iPad and they're obviously still around after the iPad.

p.s. Rumors are called that for a reason. No one truly knew what the iPad would look like. Just as people thought the iPhone 4s was supposed to be called the iPhone 5 and have the ability to fly or some crap like that.

That won't help. Apple loyalists ignore any new tech innovation that is not marketed by Apple.

When the iPhone 5 comes out with a quad-core SoC design, all the Apple fans will say that Apple did it first and every other tech company copied Apple. Apple is all that matters and everyone else is irrelevant in their sphere of focus.

Well seeing as how Apple sets the tempo in the mobile market (tablets, cell phones, laptops, ultra books, mp3 players), Apple is all that matters really.
