I don't see why everyone is defending Notch. Maybe I got it wrong, but he was the one actually trying to patent the 'Scrolls' name. Maybe Kotaku is wrong though, but it seems like Notch is the one doing the wrong here.

That. If Notch wins this trademark dispute he could use it to block the sales of Skyrim and any other Elder Scrolls game from sale. Think about the current situation Samsung is in with Apple using silly patents to block sales of their hardware.

I see nothing wrong with Bethesda trying to prevent the same thing from happening to them. Notch may not use the trademark to stop sales of the Elder Scrolls Series, but it does not mean that down the road someone else won't buy the trademark from Notch, or buyout his company and do so.

This isn't how trademarks traditionally work. Trademarking the title "Scrolls" has zero impact on the existing "Elder Scrolls" or a hypothetical "OCN Scrolls". The trademark doesn't mean they own the word 'Scrolls' and all uses of it in longer titles, just the exact, literal title. This is why it's ridiculous for Bethesda to go after Mojang on this point; Bethesda is playing fast and loose with the entitlements granted by their trademark and the courts just confirmed it, at least for now.

Did you even read the kotaku article? He applied for a far reaching patent, so yes it would apply to TES.

I wasn't going to buy Skyrim if Bethesda continued pushing this stupid lawsuit, now I'm torn on whether or not I should buy it or not. I'd like to see an apology to Mojang from Bethesda, show that they're not a company run by a bunch of money-grubbing idiots.
