You bought a used card that's supposed to look like the card in the first pic?? You need to more precise because there's a lot unsaid inbetween the lines. If you did get a ref card, that's a nice score. As for your old card, you can hack the bios and flash it too if you wanted to.

If it has the DUAL BIOS switch on it ... there's little to actually be scared about ... that means there is TWO BIOS' on your card, one is active for each position on the toggle switch ... though If I recall on REFERENCE CARDS was it the same BIOS in both positions ? and you had to FLASH your card to unlock it ?

Anyways you can always TRY my ... Step-by-Step Guide to Un-Locking a DUAL BIOS Card w/ Switch, Thanks to LA_Kings_Fan

Step 2 - You can install the CD software, but to be honest the WIN 7 driver the system auto loads for you should work too, so you could skip to Step 3 I guess ?
Step 3 - With things running, install GPU-Z and/or TriXX software or both ... then open the programs to review the Factory defaults of your card, note shaders and Core clocks etc.
Step 4 - In GPU-Z or TriXX SAVE your factory BIOS of the card. DO NOT SKIP THIS STEP. You might just need it in case something goes wrong and need to reinstall the factory BIOS file in case position #2 Unlocked BIOS FAILS, and flipping the switch back to position #1 won't reload the original BIOS for some reason. THIS shouldn't happen, but better SAFE and SAVED than sorry and SOL.
Step 5 - Shut Down Windows and turn off your Computer.
Step 6 - FLIP the little Dual BIOS switch near the back plate / SLI Bridge area to position #2.
Step 7 - Turn on Computer and reboot up.
Step 8 - Re-open TriXX and/or GPU-Z and check your Shaders ... if it's 1536, CONGRATS your card UNLOCKED and you have a HD-6970 now no BIOS FLASH required it's ON the card from Sapphire ... if it's still 1408, Bummer dude no Factory Un-Lock , you could still then try FLASHING it to Unlock it, but YES this can be slightly risky and CAN void your warranty if you BRICK the card by Flashing it, most likely you have a card that Will NOT unlock, remember it's NOT Guaranteed.
IF that doesn't show you the UnLocked Shaders, then I was RIGHT it's just TWO of the SAME Factory HD-6950 BIOS on a REF card ... ONE you SAVE and always remains a FACTORY DEFAULT to switch back to in case something goes wrong, the OTHER BIOS one you can play around with and MODIFY / FLASH with a HD-6970 BIOS to Unlock the cards Shaders and/or extra Core/Mem clocks also.

I have that card , i flashed it with 6970 bios and its been working hard like this for almost a year .

I actually suggest this card , one of the best reference 6950's money can buy . Good quality and it will unlock if it has dual bios switch ? im not sure if they have changed anything on these cards but when i bought mine a year ago it was basically a locked 6970 ... This was at the time 6950's were just released and tomshardware.com found out they just locked the shaders and wrote up a nice tutorial on how to unlock .

all i had to do was a bios flash to unlock those shaders so i just went the full 6970 bios and it works like its meant to @ 880/1375 1.175v .. no crashes or artifacts , iv benched , gamed , overclocked the hell out of this card and it just wont give up =)

I run mine at 920/1420 @ 1.2v , never goes over 70c .
