Well, for ES CPU's it's normal. Hell, it is even considered illegal to sell those on the first place, those are for reviewers and OEMs only. (it's not like Intel can do anything to stop it or force the buyer to return it tho)
I'd say get it, get a nice OCing board and a good cooler and aim for 3 GHz. 8c/16t @ 3 GHz would be some serious muscle. Plus even tho it might not be as good as the retail versions, the best you can get is SB-efficiency, and 8 cores.
