This lawsuit will be thrown out before it goes to court for 2 reasons:

-Service was never guaranteed, if they bothered to read their contract/TOS/EULA
-You can't sue the electricity, water, internet, or phone companies when their service drops

to everyone saying that they should sue due to loss of service have you never heard of single point of failure. if it was that important you should have more than one method of alert for a problem anyway. Our internet never goes down at work because we have 3 entry points of the system. Sat if we get desperate, fiber dedicated line and adsl secondary connection.

If anything is important we make sure we get it !!! this is just poeple making crap excuses for lack of work.
