[TheRegister] Samsung demands iPhone 4S source code in Aussie row

Samsung is seeking an injunction on the iPhone 4S in Australia, though the only patents it can apply are fundamental to the W-CDMA (3G) standard and thus fall into the ETSI-mandated FRAND policy. Apple reckons it is free to use those patents having bought chips from Qualcomm, and Qualcomm has a licence from Samsung which Apple has seen, but only in a form so redacted as to be useless to its case.

Apple has previously argued that its licence to the Lodsys (mobile payments) patents should also cover users of its services (mobile developers taking payments through iTunes), so Cupertino obviously believes patent rights should be transferable, but that will depend on the contract Samsung has with Qualcomm, which is why Apple wants to see it.

Samsung, meanwhile, wants to see the iPhone 4S firmware so it can establish that Apple really is breaching its patents, something Apple still denies.
If Samsung actually got the iPhone source code that would be a HUGE loss for Apple.

Not really, Samsung can't legally use anything in there to improve their phones - and if they did they'd be in big trouble.
Only way that would be a loss for Apple was if the Source somehow got leaked.

If Apple are confident they aren't breaching any patents then whats the harm in showing Samsung, in a court room, that they aren't

Unless they are being economic with the truth. Either that or hastely rewriting the code!

Source code...that seems to be going down the rabbit hole...Samsung has yet to get feedback of evidence that apple is actually violating patents. I'm neither an apple nor a samsung fanboy, but I would say that asking for source code is a bit extreme.

And I thought that one could not sue against something that has been adopted as an "industry standard" (which 3G protocols have become)--and I thought Samsung was already informed in court about this? Maybe it was a different country...

Agreed, yet this very thing was forced upon Samsung when they were told to hand over prototypes WITH software...

And whats more standard in the industry than rectangular screens? A tablet is simply a small factor monitor with touch controls, neither of which Apple created or innovated to its current form first, all such things existed well before Apple released even the first iPod, yet they seem to own this design.

I very much hope that Samsung wins this and gets what they want... I mean if the system is so broken Apple can get away with sheer insanity and some of the most stupid things I've ever comprehended in my life, it should work both ways, and they, too, should be subject to such a process.

Though two wrongs don't make a right... The system needs a massive overhaul... heck, throw it out the window completely and start from scratch. But this time around, have experts in the field helping to decide on the rules, because its pretty apparent there is a massive amount of decisions being made by people who obviously are in over their heads just hoping they aren't gonna get into trouble for doing something wrong...

Yes, but that was only after a court deemed sufficient evidence to warrant such an action. A court has yet to side with samsung that there are actually infringements, let alone further actions to verify/prove them.

I am not saying I agree or disagree with either side, only that the request is not warranted/supported with justification of evidence.

I agree, two wrongs don't make a right, and that the whole system is entirely messed up, and that's what's brought us to where we are today. A ~200 year old patent system trying to apply to things that weren't even in the minds of the most forward-thinkers 200 years ago...

You are very misinformed on the subject. Apple is not suing for a rectangle

Why don't you do this, type in Google.com and then search Apple vs Samsung lawsuit and give it a good read, take you're time, if you don't understand it the first time read it a second time, keep reading it until it's burned into your brain. You Apple haters love distorting the facts.
