Apparently some 2nd gen iPod touches were sold as 3rd gen. a "3rd gen" 8 gb iPod touch will not upgrade higher than iOS 4.1.2, just as any 2nd gen will not.
Apple basically released an 8 gig 2nd gen at the same time as the 3rd gen release, and it was grouped in with the 3rd gen (not by Apple, but retailers and consumers), but in reality it is not.
