Yes. Generic DDR3-1333 CL9 won't OC and 1600 will have headroom.
Actually it seems harsh but it's true. Since DDR3-1333 at CL9 is a minimum standard, you won't get overclocking-binned chips at all. A large majority of generic 1333 CL9 kits do not overclock to DDR3-1600 because of low-end binning. Many max out at around 1400Mhz from what I've seen.

This can seriously affect the CPU OC on locked-multiplier processors/platforms, as well as can affect performance on certain platforms, especially AMD's Socket FM1/APU.

I ordered two of the OCZ Sniper 1600Mhz kits (9-9-9-24), will that be ok with overclocking the 2500k I have coming?

they might overclock some at 1.65v
