Well, judging by Miki's location info, you do actually need permission from both parties to record a conversation in the state of California. However, neither party is required to know who is doing the recording, last I checked. And since most customer service centers already record their calls, permission is somewhat implied, especially since customer service reps understand that their company will record their calls. In this case Miki knew Miki was recording the call, and obviously gave permission. The CS rep knew that his/her company could be recording the call, and obviously gave permission or wouldn't have that job. Thus, the recording is perfectly legitimate since both parties had given implied permission. Although, it would probably be better not to ask if you can record a call first next time biggrin.gif

Honestly, the only seriously "offensive" thing the guy did is in a rude tone say he didn't care what the customer service rep told me (when I told him about the email I had). The problem with that is AT&T's customers can only go by what they're told by their customer service. For him to tell me that it doesn't matter is him basically saying, "AT&T doesn't care about customer service"... which looks very, very bad. Otherwise, he wouldn't have refused me using the recording.

Anyway, UpgradeSolution, thanks again for offering to send an iPhone 2G for me to get back on unlimited data (or attempt). ^_^

I feel for you and it's definitely not right for customer support to treat you the way they did but they did warn you about using unofficial tethering apps... even if another person used it, it is your responsibility.

Seems fair to me.

I currently "owe" them $656 (as far as my credit report states) that I've been fighting them on since 2007 because they "lost" my $100 deposit. **** AT$T.

I have never really had a problem with AT&T other than their unaccurate speedtest which indicates your internet speed is really 4x faster than speedtest.net indicates. I do think that I will switch to Verizon once my contract is up next year.
