If I release a movie with a scene that has a Samsung TV in a character's living room, am I making money off using the Samsung name? Absolutely not... and in most cases, SAMSUNG/etc. would actually be the ones PAYING to advertise their product. Why is it that Pepsi, Intel, and every other company has to pay EA for in-game ads such as the ads seen in 2142, yet EA has to pay Bell to show off the AH-1Z Viper in the game? Why isn't it vice-versa? EA is likely willing to incorporate it in the game at no cost to Bell; Bell should be THANKFUL that their amazing helicopter is being implemented in one of the top games ever released.
The article about the issue doesn't clearly state whether it was Bell that completely refused to license their helicopters (regardless of any price EA offered) or whether EA refused to pay the price Bell was setting; so at this point deciding which side is "wrong" is all speculation.

EA is making money off of using the Bells in the game. On of the most widely used advertisements for this game was, "is it real? or is it battlefield 3." If they just used a generic model and a fake name, that would throw the realism off a bit. You might say now that it wouldn't have affected your perception of the realism in the game, but you know there's no such thing as a whirlygig assault roto-craft.

Bell did not actively seek out EA to have their helicopter put in the game. You are describing product placement. That is an entirely different thing then what happened here. EA took something that wasn't theirs and used it, without permission.

This might be extreme, but hypothetically; thing about a different company buying the game and just studying the model of the helicopter in the game. They get a movable, flyable (realistic or not), fully 3d rendered model they can manipulate at a fraction of the cost than getting it directly from bell. The model in the game is very good. It even has the correctly designed exhaust ports. These ports look the way they do in order to better dissipate heat to throw off heat-sinking missiles. All another company needs to do is copy these and they have a pretty decent copy sitting in front of them.

Bell single-handidly invented the idea of the close support attack helicopter. The "Viper" is just the latest rendition of the "Cobra" attack helicopter. You should really look into the history and development of this air-frame; you will then understand why they are pursuing this.

The side that is "wrong" is actually EA. They refused to pay the licensing fee, which Bell (Textron) set.

I might have a bias for Bell, but EA and their arrogance needs to be put in their place.

I see your point about the product placement; Bell don't ASK EA to sport their product.

About the "wrong" side, do you have a source for EA refusing to pay the price Bell set? Because the article in the OP doesn't clarify whether it was EA that refused to pay Bell's price, or whether Bell just outright refused to give EA permission to use the Viper regardless of EA willing to spend millions for it.

I might be somewhat sympathetic if EA were a competing aircraft manufacturer and stole the design and name from Bell without licensing, but this is a friggin VIDEO GAME. A digital representation rendered on a computer. I said they need to get the hell over it.

If rappers get sued for not asking permission for sampling, then there should not be an exception made for EA using an aircraft model and name without permission.

I figured they would have had to pay EA to have it in there...not much mind you since advertising isn't that important for combat helicopters

...but one day some one will be deciding a military contract and remember flying their bird in BF3 and smile. It is called product placement.

However, if the logo was used without consent then there could be issues. Incoming patch for BF3.
