but it has happened tho as news reported... so it's not as unlikely as expected, as for the legality of it only looking through the current EULA you'll beable to see if it's there or not... Microsoft supposably disabled the feature of Kinect sending anonymous data to them Video or otherwise Audio formats but no one knows if it was truely disabled or it was stored somewhere else and still storing. the bandwidth, the video quality of the Kinect system isn't great and as far as i can put it is that it would be like fraps or something where it has time limited splitting the files into parts then once it's on the server it stitches them together once a session is done which saves bandwidth from sending big filesizes. that seems logical when transmitting video, Streaming wouldn't be much better but could be another likely scenario.

They never removed the feature, it's simply a web cam designed for video chat and picture taking with your xbox. It is still alive and well and fully implemented. My childrens accounts are set to not allow video or picture chat though, something easily done in parental controls. They would need my email password to change it.

The Kinect only records at specific brief moments during gaming, all of which you are notified of beforehand. If people would read the on-screen prompts they would realize this. "Naked Guy" obviously can't read, that's not Microsoft's fault. You can even TURN OFF the feature in EVERY GAME. You are NEVER forced to record your session or take pictures. Or you can still do it, and choose to never share it online, keeping it for your own personal amusement.

No it cannot.

1. The console must be on to take audio samples
2. You must have allowed it to do so in the settings
3. Even when enabled, it only records things it recognizes as voice commands. It completely ignores all others. It is simply trying to build a speech library for various commands in order to better deal with accents and/or differing pronunciations among different localities
