Ah, this thread brings me back about 3 years when I was writing my 25-page term paper for a Jurisprudence class...it was about this little thing called the DMCA and the uphill battle we all faced with terms like, "copyright infringement" and "fair use" with purchased digital content in the digital era. thumb.gif

Bottom line is, people had better start reading the fine print when it comes to any content you buy digitally, and accept that in almost 0% of your purchases do you actually own the content as opposed to a license to use that content, provided that you agree to any services tied to that content which can be severed at any given moment since, well....you do not own that content you just paid for. wink.gif

Our justice system does not have as clear-cut a path of decision making when it comes to protecting intellectual property vs. fair use rights...yes, there are a few precedents, but nowhere near enough to assume that courts would swing one way over the other.

People have to understand that digital distribution companies HAVE to say that they can revoke your licenses or use of their services without any rhyme or reason, or they open up pandora's box on themselves...it's just their way of covering their butts, as harsh as it seems.

This whole, "do i or do i not own it" system when it comes to digital content will most likely never change, simply because the system will work for the majority of people who will never have a problem with accessing their purchases, even if there are innocent victims. Not when a license can be prematurely terminated due to bad decision making on their behalf. Like in my case with Steam/Blizzard. Sure if I was in the wrong then I wouldn't have a problem, my bad, time to move on. But I wasn't in the wrong, and still had my account fully banned, only to have Steam tell me to `Shove it` (Can't post what they really said as it would be against OCN's rules smile.gif )

It's much like the PS3 fiasco with GeoHot making CFM for it. While he won the iPod jailbreak decision in favor of 'he bought it he can do whatever he wants with it', Sony wasn't so easy on it. Apparently we agree to Sony's ToS before we even open the box? I don't remember the cashier handing me a Sony pamphlet and asking me to sign it as I agree with it.

No you don't own your games and I can tell you this from experience about a year ago i had about 60 games on steam. I had just decided to finally setup a bank account because I was actually finally got a job with a steady income. After purchasing a $50 game on steam the very next day I look at my online bank account statement and somehow I managed to not only see I had no money but I was in the hole by about $45 dollars.

My lack of common sense and the inability to manage money properly. Needless to say without me realizing I had pending charges on my account that didn't go threw so I thought I had plenty of money left over to purchase this game. Because I did not have sufficient funds to cover the game my bank charged me a $35 overdraft fee. The rest of the money was going to go towards food for the week. So basically I was going to starve if I didn't figure out how to correct my mistake. First thing I do is contact steam support telling them my situation and they just gave me a generic response of all sales are final, no exceptions. Desperate I plead my case and try to reason with them and practically begging for a refund. Needless to say that didn't matter as always customer support people are like robots they are given a set of rules and no matter the circumstances they won't even bend them.

Anyways my next course of action was to go talk to my bank. I explain my situation and they sympathize with me. They make an exception and waive half of the overdraft fee and also reverse the transaction which essentially gave me a refund for the game. Not even a week later my steam account is banned all 60 games are no longer playable. I contact steam again asking why my account was banned. They simply told me that since I reversed the charge on the game that they had a right to close my account. They also told me the only way I was going to be able to get my account back is to give them back the funds.

So I say screw that I'm not losing hundreds of dollars worth of games essentially my entire library. I put the funds back in and months upon months go by and in all this time I'm battling to get my account restored basically fighting with steam for months on end. In the end though I get my account back.


p.s. i forgot where i was going with this post sorry barely had any sleep.

With discs, it is just a copy of the game that requires a key, in order to work. They can ban you key, so do you still own the game? No, you just own a physical copy......with no cd key, therefore it is rendered useless.

Buying a physical copy is not a sure thing either like you questioned. Many retail copies have silent DRM installs such as SecuROM and Tages Solidshield that restrict your install usage and lock you out of your game.

If you read the fine print, we don't own games anymore anyway. Nearly every new game is licensed to us, and revocable.
With most games requiring a sign-in to install, let alone the ones that require a sign-in to play, do you really think ownership is possible? How long will the servers really be up?

I don't see much difference between hard copies and digital with the way things are now. Sad to say, but pirated copies often offer a better customer experience than paid copies. I can't play most of my recent owned copies of games because it requires an internet connection to go to offline mode, or I'll often be plauged by "offline mode not available" in SC2 for instance, even after going through all the hoops they require to get it working.

Licensed to play is the direction the industry is going.

Here's some food for thought. Games aren't a necessity, they're a luxury. What this means is if companies like Valve or EA started ripping your digital purchases away from you and screwing over the consumer, they would begin to lose a lot of business. It's the bashlash that they would endure that prevents them from doing the stuff this article talks about. They're not going to be screwing over their income source anytime soon, and if they do, they'll pay for it (or not get paid for it).
