...They worked on WarCraft 3.

They did not work on DoTA, at all though.

Icefrog is hired by Valve, and has been, for awhile, so yes, he is making money off it.

DOTA is a standalone game using a custom standalone map. The ONLY connection that Blizzard has with DOTA is that the original creator of DOTA (first version) used Blizzard's open sourced mod tools. Blizzard did not spend a single hour developing DOTA, they developed W3. Other modders took DOTA and expanded on it with their own variations, again without the assistance of Blizzard. Now if you were arguing that without W3, there would have never been DOTA and that argument/scenario is plausible if highly unlikely, as Eul could have easily made DOTA using another set of tools. The biggest thing here is that not only had Blizzard failed to ever assist in developing DOTA, they had all these chances to take advantage and beat to Valve to the punch, but chose not to instead. The only reason they are doing anything now is because they want a piece of the pie.

DoTA existed before Warcraft III.

It started in StarCraft, Aeon of Strife.

What I find funny is Tower Defense started with StarCraft, WarCraft III made them all the more popular, but you've never heard Blizzard complain about that once, when every company and their mother made Tower Defense clones, something that DID originate from their games.

But DoTA, well, Blizzard had plans to make money off that, Valve just did it first, and it's completely cool in the modding community. The only ones I've heard complaining are Blizzard and irrational idiots. What more do you need?

It's a mod, going retail, with the developer working on it. That happens every day, what makes DoTA so special?

I thought it started with W3 mod tools and used SC map. So it started even before W3?

It is only special, because of the parties involved. Both Blizzard and Valve are highly regarded developers and publishers.

Well with Eul with Valve (did not know that, haven't checked up on anything DOTA in years) I'm going to have to side with Valve on this. If Guinsoo was with Blizzard that would turn into one heated battle, but none of the major DOTA contributors are with Blizz (AFAIK).

The game type existed before WC3, but not the specific name DOTA. Theyre not fighting for the rights to the game type, its about the name.

I have to agree with Blizzard on this one. The game has been around what a decade? and helped made into what it is today by more then just a couple people. If valve was copywriting "Dota 2", I would agree with valve, but they're not they're going after what has already been around forever "dota". IMO this is like apple trying to patent a feature that's already been around for a decade and used by everyone else. Blizz is also not flying solo on this, Riot's developers which are guinsoo and pendragon; two who are also major participants in making dota and its comunity, are also doing or did the same thing, it was a while ago, so I am not sure if there's already been an outcome or not. Which version do you associate more with the current gameplay mechanics? Defense of the Ancients or Dota Allstars? I'd say Defense of the Ancients playstyle was so vastly different from current mechanics that it is an entirely different game. I don't think you could say that from Guinsoo -> Icefrog.

Dota was made using Blizzards mod tools. Has anyone read the EULA of the mod tools? There may well be a clause saying that anything made with the tools Blizzard owns. It would not surprise me as Apple does the same with some of their stuff. Now if there is nothing in the EULA that came with the tools and the original person that created it is now with Valve... I could see this ending badly for both sides.
