It is only special, because of the parties involved. Both Blizzard and Valve are highly regarded developers and publishers.

IIRC any map created by any user is owned by Blizzard. Now does that include things like names? That is where the gray area is for me anyhow. Valve/Icefrog have been changing the names of items and abilities in Dota 2 to make sure that they are different from anything Blizzard themselves had created in Warcraft III. An example of this would be that in Dota 1 Crystal Maiden has an aura called Briliance aura but in Dota 2 they changed the name to Arcane aura even though it does the same exact thing.

Pretty sure that Blizzard is out of luck on this one as they themselves did not come up with the name Defense of the Ancients, Dota, or Dota 2 even though the map was created using their mod tools.

I could be wrong about this but I think they always have as far as Blizzard's games go. The thing is that this is the first time one of them has gotten popular enough to earn its own standalone sequel. That and it is being made by Valve. There would be no issue if it were Blizzard developing Dota 2, obviously.

It'd make more sense at this point if neither company would get the trademark (and as-is Blizzard are not even applying for it). They can still make the game without it, but they can block other games from referring to themselves as DotA games (in essence, they would be required to otherwise they lose the trademark anyway).

DotA games are basically Warcraft 3 with non-hero units on auto pilot. I know that oversimplifies the game, but how this type of game got even more popular than the game it was modded off of still baffles me until this day.

On topic, I don't think either of these companies have the right to own the DotA name.
