The products are opened. This is an uphill struggle either way. The BIOSes do show that they are Black Editions. The serial stickers are conflicting on the back of the cards. One sticker matches the packaging. The other sticker says a different number. So really the fault here is they have the old 7970 core edition heatsink... and they were sold like this. I am not irate or angry, these things do happen, but I think its worth an apology and also a warning/heads up to the community.Strangely
NCIX has the image identical to whats in the box. According to XFX they only sell one type of Black Edition, the Double Dissipation heatsink. They currently only sell two version of the 7970 the Core Edition and the Black Edition. I have already submitted a ticket with both to try and get this sorted. There maybe some kind of new model released by XFX, however I had not been made aware of such a thing. This looks like a hybrid: it has the packaging and extras of a Black Edition, the vBIOS of a 7970 Black Edition, but the heatsink from the core edition.
[Looks like its my mistake/XFX introduced a few extra models at the same time. It didn't help that the majority of vendors and online resources put the Double Fan non-reference cooler as the atypical image for all 7970 XFX Black Editions, see below for an actual break down of XFX Products and their assorted codesRegardless

That means there is probably at least one other Black Edition with this reference stock heatsink, and paying full Black Edition price.
