[Slate]The Real Victims in the Patent Wars

Patents are supposed to reward innovation, but in the software industry, they are having the opposite effect. The patent system has become a minefield that punishes innovators who accidentally infringe the patents of others. There are now so many software patents in force that it is practically impossible to avoid infringing them all.

Patent wars are older than Apple. Heck, they're probably older than anyone on this forum. Take a look at Armstrong(the inventor of FM radio) and his legal battles against RCA. Look at Edison. Apple is just the most recent offender.

^True. They're probably the most "high profile" and vocal. But yes, with software and technology these patents have become a method to stagnation or stunted progress. There should be a clear difference between protecting a right to an idea and product instead of blurring it to include protecting a vested interest of anti-competitive agendas and allowing people to patent things they'd never make without compulsory licensing clauses. I mean a patent exists on toast and almost all methods to make it. Seriously.

I keep trying to make a joke about this, but every crazy idea I come up with yields results in Google. There truly is no room for innovation in the toast industry.

Yeah...I didn't believe it when someone else said it but I think there's even a patent on toast as in the state of the bread itself. Some of them I'd loved to have seen though they clearly are impossible like "shelf stable french toast" which claims to be bacteria and mold resistant for certain time periods while still having a "flavor". rolleyes.gif

On topic: As much as it's "unfair" I'm at least glad that MS and IBM seemed to be willing to do licensing deals instead of flat out squashing start-ups. But like everything these days patents in their current form are from the archaic past that is being clung to and holding us back from the future.

Hate to tell ya but sometimes those deals are akin to "protection" rackets that mobs or local gangs would run in the neighborhood. Not saying all but many businesses including the ones mentioned use these "deals" and wield them as clubs.

Patents are rackets, they, like copyrights, only serve to enrich a few at the expense of the many.

Copyrights, once upon a time, were only valid for up to 75 years. That has been changed to indefinitely. For what purpose does anyone need a copyright on some painting indefinitely? How does that serve humanity or culture, in general? It doesn't, however it consolidates power and wealth in the hands of an ever smaller group of people. After all, imagine if the wheel or fire were patented or copyrighted indefinitely! Where would we be now?
