I don't use YouTube, so I can't respond to that, but I don't see the connection between what Google does and what MegaUpload did. To me it's apples and oranges, but maybe you could explain it in a way I would understand.

You upload music in Youtube which is no legal. Even when you post a Video of some kind with Music background its not legal.

IMO Kim is guilty of violating the above. I know what the law is and I believe he broke it. The laws of our nation always allow interpretation. I hate the people who come on saying, "you don't know the law... blah blah blah" while thinking they do.

This is the only part where we consider you ignorant. That part of the DMCA does not apply in this situation as there was no circumvention of DRM. That part of the DMCA does not apply to hosting/transferring copyright infringed content.

The part of the DMCA that DOES talk about hosting/transferring copyright infringed content is the part that says that as long as the OSP takes down the infringing material in a timely fashion, they cannot be liable for what is posted.

I will reread and break it down again when I get out of work.

As for the part quoted above Kim said he didn't receive any "legal documents" telling him to cease and desist and/or to remove copyright material. However, notice the language he used because the MPAA and other organizations are saying that emails were sent constantly and Kim didn't comply. Apparently, there is proof of these emails which we will see.

Kim's past doesn't help him either when looking at credibility. He is known to be a liar and a criminal from his past:

I have some information on the DMCA and the linking of files as well, but it's at home. When you look at the big picture it's hard for me to see why people so vehemently defend a guy like this unless they were happily downloading copyright material and using his services.

One thing I am certain of is that the only reason the FBI has deemed to push for charges is due to political pressure from lobbyists in Hollywood. With that said, I do at least feel that going after the people in charge of the places where pirated content is hosted is a much better alternative to the bulk litigation proceedings against anybody caught downloading a few MP3's.

I would not refute the reason why the FBI is going after them. I think it's pretty clear. I also agree with the rest of your post. I think going after individuals who download a few MP3's is illogical. The cost versus the settlement makes no sense and would take forever.

It's just like a drug ring. You don't arrest the people buying the small amount of drugs. You use them to move up to cut off the supplier. No supplier, no buyers. It's the same overall logic.

Looking at his past history of arrest and criminal behavior it's kinda hard to feel sorry for the guy, he's spent his entire adult life committing crimes using the internet. Innocent until proven guilty sure, but I don't really have much sympathy for someone with a criminal past. He can proclaim his innocence all he wants but people don't change. Once a criminal, always a criminal. I'm not really big on repentance or redemption.

That said you're all right that megaupload is pretty much the same as youtube. I think the issue here is probably one of degree. Yes youtube has illegal content, but I'd bet it has a far lower percentage then megaupload did. Megaupload seemed like it was almost aimed deliberately at catering to illegal uploaders all while hiding behind the same sort of business model as youtube. Are your laws flexible enough to deal with that? Or are they black and white? Or will the courts decide to ignore their own precendents and rules in order to prosecute a foreigner?

The only reason anyone's defending him now is because they arn't his victims this time around and he was instead exploiting the big bad recording and movie industry heh.

Frankly I don't much care. Kim deserves whatever he gets imho. Again, once a criminal, always a criminal. He's not going to be hurting much anyways, these white collar criminals always have money socked away in myriad unreachable locations and I'm sure he'll serve out his sentence and be out committing new white collar type crimes a few years from now.
