Anyone who disagrees is either ignorant of established law, just wants to Kim Dot suffer, or dislikes their freedom.

Right. Anyone who does not agree with your INTERPRETATION of the law and your OPINION about said consequences is ignorant. I'm glad we cleared that up.

Now, I hope he gets nailed to the wall.

i think that if somone that is a citizen of another country commits a crime in another country it should be considered a war crime, as the other country facilitates crime by letting them live there on a regular basis

Whether he's guilty or not, he shouldn't receive a prison sentence, nor should anyone else who isn't a violent criminal. At the most, if his guilt could be demonstrated beyond reasonable doubt, fines would be more appropriate.

The American mentality of THROW THEM ALL IN JAIL is destructive, places a huge burden on the taxpayers and at the end of the day solves nothing.

The US Digital Millennium Copyright Act provides safe harbor for sites that promptly take down infringing content. However safe harbor does not exist if the site has actual knowledge and does nothing about it.[59]

In Megaupload's case, the indictment asserts DMCA provisions were used for the appearance of legitimacy – the actual material was not removed, only some links to it were, takedowns agreement was approved based on business growth rather than infringement, and the parties themselves openly discussed their infringing activities. The indictment states that Megaupload executives:

"... are willfully infringing copyrights themselves on these systems; have actual knowledge that the materials on their systems are infringing (or alternatively know facts or circumstances that would make infringing material apparent); receive a financial benefit directly attributable to copyright-infringing activity where the provider can control that activity; and have not removed, or disabled access to, known copyright infringing material from servers they control."[60]

Prosecutors claimed in the indictment that Megaupload was not DMCA compliant, and cited the example of an alleged infringer on the site known as "VV." Over six years, VV had allegedly uploaded nearly 17,000 files to Megavideo.com, resulting in more than 334 million views. According to prosecutors, although numerous takedown e-mails had been sent, none of the files had been deleted.[61]

I agree with this completely. You can call me anything you want, but you are the only one professing that YOUR train of thought is the ONLY legitimate INTERPRETATION.

Also, no matter what you say, the law is vague, and your comments are strictly your OPINION and INTERPRETATION. Until you become a federal judge they have no bearing.

There is only so much you can interpret about a law. We have laws that say "You may not kill a person" It's pretty cut and dry there. Not a lot of room for interpretation..
This situation is the same, there's no interpretation of the law. It is cut and dry.
EDIT: The same is true for privacy laws that protect user's content from MU peeking at it.

Not quite. What about self defence? This is an intepretation that may not lead to a conviction.

This.

This isn't even considering the 15 MILLION links that we're removed by the 3rd party entrainment industry.

There was no warning, what happened to this man was plain UN-constitutional.

They(not MU) are responsible for removing "infringing" content, same as it works with YouTube. They took advantage of the tools that we're given to them, removing content that wasn't theirs.

Some very ignorant people in this thread.

proof.gif All I see is an indictment that does nothing but claim MU ALLEGEDLY knew about the infringing content.

Oh, I like this. I can be the next Bernie Madoff and scam millions of dollars from people without fear of going to jail. Or maybe set up a car theft ring and steal high end cars. So long as I do not hurt anybody, then I do not have to fear jail. Jail sentences can serve as both a punishment, to those who commit a crime, and a deterrant, to those who might consider taking a criminal action but do not like the consequences, if caught.

Seriously? I'm not on the Prosecution team. They usually don't release their evidence to me before the trial. Sorry, I don't have access to their documents. Go ask the Defense.

Also, this is why we have the trial process, where Kim will be found guilty. biggrin.gif
