Even when it comes to clothing. As an employer I can refuse to hire you based solely on the clothes you wear to the interview. I can also refuse to hire you because I think you talk too much or post too much information on your facebook page. No law prevents that whether you call it discrimination or not.

Not quite true. I live in a right to work (read a right to fire) state as well. But the clothes argument doesn't hold up in our "modern" society. Several companies have lost lawsuits for refusing to hire cross-dressers and transgender people. Now last I checked those are both personal choices. The keyword here is choice. They chose to do it. That doesn't make them unemployable by you just because you don't "like" it. It is in fact according to the Federal court system illegal discrimination if you refuse to hire someone for that reason. Sure as an employer you'll make up some other reason. But the courts have not been kind to companies that said "that wasnt the real reason"


What you do in your private life excluding drugs, alcohol, or illegal activity is not within the legal rights of a company to know. Thats why we have background checks. This facebook nonsense is just more excuses by companies to know and control their employees private lives.

You misunderstood why they won the lawsuit. The laws specifically state that you cannot discriminate on sexual preference or gender identity, but make zero reference to clothing or dress. I have been involved in lawsuits where my company was sued for not hiring a woman based solely on her attire. She lost and was scolded by the judge for bringing a frivolous lawsuit. It was also recommended that she find another place to shop for work clothing. We also had a guy sue us because we didn't hire him due to all of his piercings. He also lost. My SO has setup hiring guidelines for several Silicon Valley companies and there are specific guidelines concerning discrimination and dress or clothing is not one of them.
