That doesn't sound right. Uninstall MSI Afterburner and Sapphire Trixx if you have them installed (they can sometimes cause conflicts - if performance does not improve you can safely reinstall them afterwards).
As recommended above I'd also recommend running driver sweeper or ATiMan, there might be some conflicting registry entries from your previous card.
Use GPU-z to make sure your card clocks are increasing under 3Dload.

CPU OC was stable and all. I'm starting to think gigabyte sucks, I only ever seem to have issues with gigabyte
