Hmm... That's a good question. I'm assuming that whoever you bought the iPhone from is going to have to call on it to unlock it cause his name was on the contract and since you're not on a contract with that 4S, AT&T will still assume it's under his name. Your Atrix contract is completely separate.

Bring it to an AT&T store to see what they'll do, won't hurt you to ask. If they say it's not registered to you and that you bought it off of someone, they might say that person will have to unlock it, or they'll probably sales you into getting a new 2-year contract, which I'd avoid.

I don't understand why phone companies lock the phones to their network anyway. Branding I get (and despise) but locking? You, presumably, got the phone on their contract, which you are obliged to pay, so you're obviously going to use the contract you're paying for! If you bought it PAYG then there should be no branding or locking of the phone!

Update:

Called AT&T and surprisingly they will unlock it for me.
