That's a bit how I understand it. The whole situation is a big grey area but legally it is pretty cut and dry. If this had been his personal deviantart page with his own work as opposed to providing them specifically for others to use it may have changed it a bit as well. I don't claim to understand the laws completely but I have yet to see a good reason why he should be allowed to continue, only things like 'but I'm a fan!' or 'I don't make money'.

Please explain why http://www.falloutwiki.com is allowed to stay online. Looks official, no? Uses the Fallout name and everything, but with a "wiki" tacked on there much like a "posters" might be. After all, this is taking away revenue from Bethesda; they could have made their own wiki and generated traffic to their own website.

Bethesda already contracts out the production and sale of fallout poster media. Producing your own and distributing it infringes upon that.

falloutwiki doesn't distribute physical or digital media. It's an information-content page, not a media distribution outlet, which is the main issue with the person in this story.

How is that relevant to anything? It distributes screenshots, artwork, official logos, etc., but since they're not called posters that makes it okay?

I just lost a lot of respect for Bethesda. I thought they were the one and only company to actually listen to their fans, not stab them in the back with a lawsuit for giving them free advertisement at the fans cost.

It has nothing to do with the name. Wikis are an establish part of the internet, both culturally and legally. They use their content under fair use license. Fallout-posters was not. The name isn't so important as much as the purpose of the site and the way it was being used.

Don't blame "Bethesda" completely. This is their legal team who probably works 75% independent at tackling these sorts of things. They are right, mind you, but Bethesda the software developer is different than Bethesda's legal teams. Notch had a similar thing (both with Bethesda, I believe and with his own legal team). While they are part of the company, they do their job and the developers do theirs.

They may be right, but was it the right thing to do? Wouldn't the developers have the final say in this as it is their own creation?

From whose perspective? Sure, from a fan it seems like they're just being idiots. But from their perspective it obviously was necessary. Perhaps they've seen sales drop drastically from the time the site went live. Perhaps they plan to offer posters on their own website in the near future. Perhaps they've allowed this sort of thing for other games in the past and it has been a huge mess.

Again, I'm not saying Bethesda is 100% great for doing this but to say they are wrong, being dumb, backstabbing fans, etc. is just ridiculous. And it doesn't belong to the developers, it probably is owned by the company as a whole. Developers just work for the company. I'm sure there are other ways of structuring it but that seems the most likely in a company like Bethesda.
