Yes, Bethesda is within their right to shut down this kind of site... but Bethesda legal should start really consulting the companies PR team before taking action. I'm sure this could have been handled in a friendlier manner without causing the company to look as bad.

'tis really a shame. Should this guy have made this site? Probably it wasn't a good decision. Is it in Bethesda's legal rights to pursue this? Yes. Is it smart? Probably not. You don't attack your fans.

Practically (not morally), Frankly, Besthesda doesn't need more bad press. When Skyrim came out, the BBC's front page (of all things) had an article about how the bugs made it "literally unplayable." CNN had several articles saying the same thing. When bad press starts getting into the non-gaming, general-interest sites, that's a big problem.

My point is, they had a PR problem, and they made it worse- when they were already in hot water. Talk about shooting yourself in the foot.

It really doesn't matter if it was a legal firm acting on the behalf of Bethesda. It's Bethesda's name. That is what matters to the public, non-gamers, (i.e. investors).

I'd recommend to them that they quickly apologise and backpedal to shut this whole thing up before it explodes beyond specialty media like Gameinformer.

Those are my thoughts.

Read this earlier today and thought about it a bit. Went back a second ago to see the site and noticed they didn't even have ads... this is crap on Betheda's side. If it had ads, I could see them kind of having a point (owner making money off of it - which shouldn't hold as it's user made content), but it didn't have a single one from what I could see (didn't really explore). If Bethesda succeeds and/or they (posters) stay down, I'll definitely think twice before buying Bethesda product... ie I won't.

The only thing left is that these do look a lot like the ones in game... but it sounds like he re/made them himself. Bethesda, just back off, we still like you, but knock it off.

Except in this case, he did not steal a bunch of posters from Bethesda, he has created his own in the style of fallout, and this fallout style was used back in the 1950s so it is not a style bethesda owned, so he is not in the wrong. Its like someone went and read a documentary style book on ww2 and decided to write his own. Is it stealing? No

Fallout is registered by Bethesda Is agreed but there are other companies that have claimed trademark status for the uses of the word fallout. One of them being falloutx that provides dietary products and another company that is simply trademarked the word fallout. If you would like you can take a search in the us trademark database. As for the domain name being official and misleading that is not the case, if you visited the site and scrolled down to the bottom it explicitly says this is in no affiliation with bethesda.

If I made a game and had fans dedicated their money and time to setup a fan site for my game I would be humbly honored, why because I feel appreciated for the work. Once again there was no copyrighted material being distributed.

Laws are laws. The website must have broken multiple laws that cannot be avoided. The article could be biased, not reporting anything else.
