IIRC, there are already detection filters in place. It would still be possible to counteract the algorithm by injecting noise to confuse it. Think of capchas. You could write a program to read in text, but throw in noise and the process falls apart. It's nearly impossible to totally prevent copyrighted content from being uploaded. If youtube is going to be held responsible for the uploads, then they have two choices. Deal with it and pay up, or shut down access in Germany. It's a zero sum game if the host is responsible for user's content.
