Among other things, New York Judge Gary Brown explains in great detail why an IP-address is not sufficient evidence to identify copyright infringers. According to the Judge this lack of specific evidence means that many alleged BitTorrent pirates have been wrongfully accused by copyright holders.

My faith in the judicial system's ability to recognize, or at least not totally ignore, the completely obvious has moved one step closer to being restored.

Excuse my ignorance in how IPs work, but are they, the IP addresses, owned by the ISP? I mean, I understand that all computers have IPs, but is the IP address I use to connect to my ISP owned by them or myself?

If it by the ISP, wouldn't that mean all the lawsuits should go against the ISP, just like parking tickets go against the car owner, not necessarily the person who parked the car? Wouldn't the ISP be the responsible ones then to what ever was downloaded on their network? Seems like this would greatly curve the lawsuits, as the ISPs would have a much larger purse to fight off these flimsy claims.

Course, I could see the ISP getting really strict and restrictive in what you could do on their network then too. Nevermind then, I'll just try and play it safe. whistle.gif

Not all ISP's are huge corps with deep pockets. We use a local ISP at work that leases the physical line from a large DSL corp.
