First this happened during Snow Leapard also it was found to be a faulty kext or some such thing.

This situation is quite unique, I don't know who might done this to put thenselves in the situation. The legacy filevault was only on the home folder the new file vault is the whole disk and if it's new enough AES-NI. When I upgraded I decryped my disk and upgraded then re-encrypted. Apple will patch the system, they won't talk about it and we'll all move on. No computer is safe if you give someone physical access to the system it's silly to think otherwise no matter what you base your "standards" on.
