But the jury was unable to reach a decision on whether Google’s Java clone constituted “fair use.” A fair use decision would let Google off the hook.

Very interesting. I haven't followed this very closely, but I would agree with the bold part.

On the other hand, if the following is true:

Then wouldn't it imply that the idea of fair use is beyond the scope in which Google/Android used Java platforms? So no one really NEEDS to determine what is and is not fair use?

1) Are you a programmer?
2) Did you follow the trail?

If no to either of the above.... stop with your bias.

If people think software patents are ridiculous now, if people could patent API and interfaces.... consider the US software/tech industry dead due to litigation.

so basicly being creative and inventing stuff became useless cause any big corp are gona sidestep like this?wow just because the jury doesnt understand the ramification !java is on everything ,everybody want to use java for free.windows did this now google!basicly just copy and paste c hange it a bit and rename and your good.i bet this will get rid of any inovative idea programmer had for the futur .what is the point of making something if any corp will steel it!

Google developed their own Java Virtual Machine called Dalvik. Google built it based on how the standard JVM but did NOT copy the code. They did duplicate the programming interfaces.

IF companies cannot duplicate interfaces, then all commercially owned interfaces are off limits to development in fear of litigation. Inter-product communicate and usage would be dead. Open source would not be able to access any proprietary systems.

Why is it that companies just can't seem to get along? It seems like one would sue the other if they so much as sneeze in a similar way. I don't see what Oracle has on Google, I mean, I've fiddled with Dalvik before, it is remotely similar to Java, but not as close as most people think it is.

Not only could open source not communicate with any proprietary systems, but proprietary systems couldn't interface with each other unless there's the proper liscencing lined up on both sides. It'd be a total mess, essentially requiring either the owners of the licenses to "release" them for free (or dirt cheap), or entirely new, fully open systems/languages be developed. It's basically like hitting the "reset" button on all the millions of man-hours invested in developing our current software and development stack/environments.

Everything would be locked out of everything else.
