Nah, sounds like you got a bad card. That should not have happened, and I do know newegg will sell used cards as new (which is obviously not cool, it has happened to me before with newegg). Under that condition I would definitely RMA the card, sounds like you probably got a unit that somebody else returned possibly.
Nobody is saying you should put up with a bad card with the shroud not properly attached. Abusing RMA policies is not cool though, it ruins the hobby for all of us - but again, you would not be abusing it in this case. I really dislike newegg for this but there have been a couple times that I received a clearly used card as new, which is another thing I don't like about people circumventing RMA policies - although clearly newegg is in the wrong as well for selling used cards as new. (note - I am just theorizing about why your card is like that with the loose shroud however in ANY case you received a bad card IMHO)
