[DM] Samsung prevails against Apple, U.S. Galaxy S III to launch according to plans

What do you do when you can’t innovate, well you sue those who innovate. That has been Apple’s big moto for the past years. The Cupertino-based company has recently requested an early injunction hearing against Samsung with one goal in mind, to ban the sale of the U.S. Galaxy S III on June 21. U.S. District Judge Lucy Koh has denied Apple’s request by simply saying that it will “overload” her current calendar. The iPhone maker will still be able to hold a hearing but it will not happen at this time.

Following their somewhat failed WWDC 2012, Apple does not have an answer for the Galaxy S III at this moment. So why not try to get it banned until they are able to launch the next iPhone, right?

Nice try Apple, nice try…

All I have to say is - GOOD.

I can't stand Apple. Just can't stand that company!

I never read the other thread but what is Apple trying to sue them over this time? Can't be the design because they made it curvy specifically for that.

I read somewhere about it being S Voice. But don't hold me to that.

As a kick to the groin I would have SPED the release of the phone ahead of schedule a week or two, and on top of that spread out a massive advertising campaign mentioning something along the lines of "Fail troll is fail."

I believe this is the reason:

? No, Siri is owned by Apple, they bought the developers out in 2010. Siri was originally going to be released for Blackberry and Android, then of course Apple took it and halted production for all the other platforms. rolleyes.gif Samsung actually developed S-Voice.

Didn't Vlingo develop S-Voice?
Doesn't Nuance own Vlingo?
Doesn't Apple own Nuance?

S-Voice is powered by Vlingo, but not developed by them. Yes, Nuance owns Vlingo, no, Apple does not own Nuance. Samsung developed the app called S-Voice, Apple owns/now develops the app called Siri. Both happen to be powered by Vlingo. Saying S-Voice shouldn't be allowed to be powered by the same engine Siri uses is like saying HP computers shouldn't be allowed to be powered by Intel processors like Sony computers are. There is no exclusivity license between Nuance and Apple saying that Nuance cannot serve any other company.

I didn't know that a judge delaying hearing the case amounts to Samsung prevailing. rolleyes.gif

Not your fault, but it's the common misconception on this topic that it has to do with the voice interface. Which it doesn't (at least, not on paper). It has to do with Apple's ownership of a "universal search" patent, where a search topic is entered in one location, but then the service searches multiple locations simultaneously as part of the same search (i.e., the search subject might be spoken to 'Siri' after which the 'Siri' application initiates the universal search). The search doesn't need to involve Siri or any other voice-input interface in order to violate the universal search claims.

Regardless, if this is considered a win by people, then I've won many arguments.
