I have an i5 2500k @ 5.0GHz and an HD7970, and it stutters really badly for me even at medium settings. When I had my GTX 580 though, it was butter smooth 80-100 FPS all the time.
Try turning your shadows down, and maybe the draw distance. That helps me quite a bit with my 7970.

Any tips to improve performance? And on windows rating my Harddrive rating is 4.9.. lol i dont know if that could cause the lag in this game though. Also on the same exact game on my brothers computer he gets 30+ Fps and his specs are i5 2400 ( stock) gtx 560 ( stock) and 8gb 1666mhz patriot ram.

LOLZ. I run the game fine braa. Run it maxed out at 1080p braaa. Got it modded to high heaven braaaaaa. see no less than 35 fps braaaaaaaa
Again, proof? 35 FPS is fine, assuming you can keep that up in the middle of the city with a lot going on (in other words, the EFLC benchmark).
My i5 at 5.0GHz with a 7970 can't max out the game, even at 800x600. I've tried it with an HD5870, and I had the same results. Having an Nvidia card, even a 9800GT or GTS 250 in there...it plays smoother.
