Right guys ,it is not OK to reuse an OEM key.

Just because you call up and ask for a license key and you are given one does NOT make it OK. Not getting caught is not the same thing as being allowed. The operators that are manning those phone lines do not have the training (or inclination) to determine if you are installing on a new machine or not. The license is clear; OEM = one machine only.

OEM licenses are cheaper for a reason, and it has very little to do with not having a box. It is cheaper because eventually you will need a new machine and will then have to buy another copy of the OS. So next time someone suggests that installing an OEM OS on a new (read: not the original) computer is OK; will get a Piracy Infraction.

Notes:
  • Minor hardware changes are permitted
  • A motherboard change is never minor
  • Hardware failure may not allow you to re-activate a license
  • This thread is about licensing not morality
  • MS will often allow you to re-activate even though they shouldn't, they have stated this will not protect you from prosecution
  • If you are upset about the licensing issues of OEM software complain to your system builder

The license states that it is good for 1 PC only. Microsoft has defined 'PC' as a mobo for the license (used to be an HDD IIRC) so your license lives and dies with the mobo

If you want to reuse an OEM key or have reused an OEM key in the past then best of luck but you may not discuss that here (this includes methods of reusing such as lying to the the MS reps)

Well I guess you could somewhat do that but that would be breaking the EULA and would be considered as software piracy. So it's kinda illegal if you do that.

It's not tho if your only really using it on one computer. You bought it and it's your copy of Windows. I would understand if you were trying to us it on more than one computer at the same time.

By "re-use", he means in the sense of transferring it from one motherboard to another. The entire thread needs to be read in order to have the correct understanding.

Besides, we don't own them; they are licensed to us. Microsoft is always the owner.

There is only one situation when you are allowed to move an OEM copy to another computer (motherboard) and that is when you have replaced a broken motherboard under warranty with the same model.

That is it.

I think this is where the whole "phone up the rep and tell them x to get a new activation" comes from. The rep may well erroneously re-activate your copy in this case, it does not mean that they should, or that you haven't gone against the EULA.

If it's an OEM install, you need a new Key if you swap motherboards. If you keep the same MOBO there shouldn't be any problems as far as I know. I personally experienced an OEM copy not working on a new build, so If you're not looking to run into issues with the new rig then simply buy a Retail CD.

It's worth the money, if your motherboard dies and you decide to get a new one you'll need a new OEM key in the future, if you had a Retail Key you could swap it no problem.

Quote:
Q. Can a PC with an OEM Windows operating system have its motherboard upgraded and keep the same license? What if it was replaced because it was defective?

A. Generally, an end user can upgrade or replace all of the hardware components on a computer—except the motherboard—and still retain the license for the original Microsoft OEM operating system software. If the motherboard is upgraded or replaced for reasons other than a defect, then a new computer has been created. Microsoft OEM operating system software cannot be transferred to the new computer, and the license of new operating system software is required. If the motherboard is replaced because it is defective, you do not need to acquire a new operating system license for the PC as long as the replacement motherboard is the same make/model or the same manufacturer's replacement/equivalent, as defined by the manufacturer's warranty.

So basically, Microsoft says that it is ok to change out EVERYTHING in a computer, except the Mobo, but if the Mobo goes bad, you can even use a newer motherboard, if that company lists it as an "equivalent". For example, if you have an Asus P6T6 motherboard and it died (and is no longer manufactured), you CAN use the newer Asus Rampage III Extreme (which isn't on their "discontinued" list).

That is a 100% legitimate "upgrade" and is spelled out in the Microsoft OEM agreements.
