They used poor quality TIM I think, but that only matters when you overclock it significantly. Ivy can also handle hotter temperatures than Sandy, so it is not as serious a problem as it might seem. The OP said:

back to topic go with the 3770k and a evga gtx 670 superclocked it's a good card I would also consider a cooler master hyper 212 plus CPU cooler

Xeon? I thought that the main appeal of those was ECC RAM.
I would strongly suggest a GTX 480 over a GTX 560; though, a 670 would be better if you went with that previously suggested build.
A caviar green is better than a black for storage, as speed doesn't matter for storage.
I think the 600T is a better case than the 550D.

The TIM isn't the cause of the increased heat in IvyBridge. Intel actually just came out and admitted it was because of the shrink itself, the 22nm shrink has a little too much leaking going on, thus increasing the heat.

Not any more, now the Xeons are hidden little gems. I actually picked the wrong one originally. Here is a new build based on your advice:

CPU: Intel Xeon E3-1230 V2 Ivy Bridge 3.3GHz (3.7GHz Turbo) $240 - this one has hyperthreading.
Mobo: MSI H77MA-G43 $87 (H77 chipset since Xeons don't OC)
Case: NZXT H2 H2-001-BK $110. I agree with the 600T suggestion, but would rather put that $$ into a gpu.
GPU: GIGABYTE GV-N670OC-2GD GeForce GTX 670 2GB $400
PSU: OCZ ZT Series 650W Fully-Modular 80PLUS Bronze $68 after mir and promo: EMCNDHA22, ends 7/5

If want to get Sandy Bridge i7-2600K instead, better get Z77 board, not Z68/P67, basically not previous gen chipset. At least with Z77 the OP have choice to upgrade to Ivy Bridge later.
