Millions of dollars of Eula re-writes, plus millions of dollars for the team of lawyers, plus losing face at a federal level and having your EULA shredded by a Federal judge, plus having the media put you down as a wolf in sheep's clothing for CPA/Amendment breaching clauses in the EULA...Not to mention the hordes and hordes of people that will then dump the Xbox because the EULA will actually be spelled out to them for the first time...

Or

Settle to about 1000 people for violating their warranties?

Guess which one Microsoft will choose if they have a brain?

Violating a TOS doesn't mean in any way the law isn't on your side. The TOS is a set guidelines from the company, but if a legal court systems deems the companies actions to be unlawful then the TOS agreement doesn't mean anything.

Atleast my PS3, if I Chooose to do Online play, I dont have to pay anything...

Not that i would really want to play online anyway, Ive got a good PC for that.


but it is wrogn that they can put in a EULA these sort of stipulations.. I understanned being banned form an online service for almost ANYTHING BUT REPAIRING YOUR OWN SYSTEM!!

Like I said, considering the current state of our courts, if she pushes this to the federal level, the entire EULA is now not valid, meaning she wins over the ToS/Eula and again, considering federally EULA's do not hold water, she'd actually win the breach of contract//Violation of her consumer rights.

So, if she takes this case FAR ENOUGH, she will win...Period.

TLDR: If Microsoft doesn't settle this before the federal court...She will win.

I think Microsoft will settle this out of court fo rher, give the lady life time Xbox Live and call it a day

otherwise they will lose at the federal level and all those poeple will get refunds.

If they settle now, quietly, then those people will be out of luck and the dozens of users int eh future will think nothing of it and move onto PC Gaming instead lol

How is banning someone for modifying the hardware on the unit not legal? She has little grounds to win. She modified the unit which violated EULA, Microsoft banned her console. She can file a class action lawsuit all she wants if Microsoft can't stop her, but it won't get her anywhere as far as getting unbanned goes, as she modified her console. Microsoft is not obligated to replace her unit if it was out of warranty at the time that the drive broke, nor are they obligated to price-match the replacement of the drive with the person she had it replaced with. If they weren't a Microsoft-authorized repair center, it was an illegal modification. If you modify your cable box and it gets you a bunch of free channels, don't you think your cable provider should have the right to take action against you? (She may not actually pirate games, but the replaced drive has the capability of doing such).

Regardless, what did you mean by "You can't just put whatever you want in there. It still has to be legal?"

Supreme Court themselves ruled that it's legal for companies to deny their users class action lawsuit privileges in their EULAs.
