A patent holder has to sue when they are aware of infringement or they lose the patent.
I do agree that they should focus on more important things though

Only problem with that is you can't patent a sheet of glass and sue anyone else who uses the concept as well. It'd be one thing if the Galaxy S II+III and the Tabs were blatant rips of the iPod/Phone/Pad... but I own both and can easily distinguish between both.

They are also suing HTC, Motorola, and Google just to name a few... just come out from under your rock and read the news. They declared "Thermonuclear war" on Android and are hellbent on hurting (or as they blatantly announced- "Destroying") Android supporting companies.
