This wouldn't probably hurt the pump, but it will more than likely raise your temps a little bit, but nothing to worry about. If you can get the clearance by removing that heatsink, do it. Just make a nice cover plate or something along those lines.

You could always get some smaller ram or mofset sinks, file them down, and put them on top of the pump if you really wanted to.

If the heat is a big problem on theese pump, why are the normal MCP35X sold without any heatsink on, cant be that bad then ?

Dont plan to run it a 100% (Maybe 50%), and will be looking at some low profile sinks - Something like this maybe:
