You people worried about going after users can rest easy. Just using a private tracker like Demonoid never stopped anyone from joining a swarm and pulling IP addresses. You as an individual user are no more at risk then you ever were using Demonoid.

If a file is not hosted on the site then the site should not be held accountable. In my opinion.

It's still a huge grey area, but I believe that even simply hyper-linking to copyrighted / illegal material is still punishable as hosting. Something about providing access to it... I don't agree with it myself though.

In most cases, however, simple linking is unlikely to violate the law.

This kind of sums up how I feel. Things will never be the way they were in the first box again. Even if people stop pirating music, there will still be pandora, spotify, youtube and *gasp* the radio. The problem with the Oatmeal comic is that the end of the comic already exists and yet...hardly anyone uses it and hardly any artists will switch over to it. It's called Bandcamp. Also, the Oatmeal comic indicates a little over-generalization and demonizes certain areas. The recording studios deserved something in return for the mass production, promotion, and other costs they incur. That said I'm pretty sure their management is poor on finances and adaptation so they've resorted to protectionism tactics to keep their status quo. So yes, I'm against them but I'm not blind to wrong actions that a lot of people think they're entitled to perform.
