So using an icon of something that is generally associated with it can fall under a patent? Seriously?

Making a phone call...I think of a phone and sure enough it's usually a phone
Notes...I think of legal pads
Messaging is open to interpretation, and they are very different.
They normally call them address books...and I don't know why it can't look like an address book.

There are a lot of other examples, but there should be absolutely nothing wrong with using a commonly thought of object as an icon...

I use Apple and Samsung products and do not consider myself a fanboy of either brand, or any brand for that matter. I personally assess every device/software/hardware on it's own merit, regardless of manufacturer. Having clarified that, onto the argument.

It doesn't matter who started using these icons first - Nokia, Samsung, Apple, PCs. All that matters is who files patents for the designs first. Apple filed patents for the design of their icons, therefore they own the rights to them. Also, you need to consider that Samsung used EXTREMELY similar designs to the ones Apple had patents to on a device that is EXTREMELY similar to an iPhone, which was released and patented first too.

I think anyone with more than half a brain can see that Samsung have therefore clearly infringed Apple's patents here. Considering that the designs are almost identical and are being used in the exact same context (which MUST be taken into account), it is obvious that Samsung are in the wrong in this particular case.

Forget who first designed or implemented the icons, that is irrelevant. I'm not saying that I agree with it, but that is just how it is. Accept it and move on.

Stop jumping on the Apple hating train automatically, just because it's Apple. You are just showing yourself to be an uninformed halfwit.
