Well maybe the right to the code of the software but not the function.
So people can't just copy & pasta the code but if they are good enough they can come up with others ways to make it work... maybe even better ways.

Actually as far as I know it is legal. It called black box engineering. Basically it's legal to copy functionality as long as the one doing the copying has never seen the original code. Its how they got DX9 working on Linux for example.

Your right patenting is taking it a bit to far and Apple should be relying on copyright and trademark's to protect there GUI ICON's but in the end its all intellectual property and it's no better if Apple sues for copyright infringement instead of patent infringement.

Clean room engineering only protects you from copyright and trade secret lawsuits. Some Software and most business method patents are only concerned with doing something, and not how its done. Thus, there are no ways to work around some types of patents; they literally patent the act and not the implementation.

For example, a company patented scanning checks for processing. Since you pretty much have to scan checks to process them, there was no way around the patent. It was so bad that Congress was considering claiming eminent domain on the patent, because it could have basically ground all check handling in the US to a halt. I don't know what ever came of that.
