I hope that jury and court realise that that persons life is now ruined, he will never be able to get a home loan, car loan, and will be paying off the costs for the rest of his life...

Sure you can argue that he was in the wrong, but lets be honest, how many 16 year olds HAVNT downloaded music? Fining them and DESTROYING their lives is NOT how to fix the problem!!!

No no, it's ridiculous of course, but it's not his whole life. Well not here in the US at least. You file for bankruptcy, can't do any of those things for like 5 years, rebuild your credit and go about living.

I just don't buy that. The initial fine was £3300, that doesn't ruin your life, even at 16 it's maybe an extra year before you get your first car or your staying at your parents house for another six months. What ruins your life is trying to counter claim/non-pay a huge company with massive resources when they have water tight evidence you've committed the crime. They could of got ten times more the first time around instead of the £3300 if they really wanted to, he had an opportunity to pay a much more reasonable amount and passed it up for the chance of going scott free. Gamble and lose is just tough luck - it's not like he didn't know he was guilty.

Who are the dolts on that jury who decided to up the damages $5,000 per song? Did they really think that was in the RIAA's best interests? They probably spent more money going to court than they will ever receive, and in doing so they have ruined someone financially.

It's not like he was selling bootleg copies of CDs. He was just uploading the music (i.e. not making a cent off it).

You don't know how water-tight their case is until you go to court. These things are not open-and-shut. There are plenty of similar threats being sent to people that would not stand up in court but companies make revenue from it. They know that if they threaten to take 10 people to court, at least one of them will pay up just to be safe.


If (settlement amount * number of people that pay settlement) > (number of IP addresses * the cost of sending a threat)
Then goto Profit

They don't have to be able to win in court, they just need a small percentage of the people to feel that it's not worth taking any chances and they have a profit making business model.
