This is one of the reasons that the Nexus 7 doesn't have an external sd slot. By eliminating the sd slot and using MPT to mount the internal sd card they are able to use an ext filesystem on the device, completely removing FAT.

It's still harder for people to transfer files, because I don't think Windows 7 can natively read MPT format or whatever it is.

Plus, as someone else said, the patent runs out next year (have not verified this). When it does, anyone is free to use it without paying royalties.

But, as said, this is fair. They're not patenting the concept of a file system. Their patent covers one specific implementation of a file system. I'm fairly sure Apple has a patent on their file system as well.

iirc most of the actual flash Android is stored on is either YAFFS2 or ext4, but the SDCards or external storage is fat32/whatever the user formats it as.
