Yes they thought 2.25% was too high for a FRAND patent. They asked to see what Motorola Mobility had charged other companies. Apple has agreed to license this patent already, but the fee will be set by the court.

WiFi patent sounds FRAND to me. I'm not blind? I've never claimed Apple is innocent. And several of Apple's patents are for key multi-touch functionality.

Did you even read the article? Apple didn't win, it was handed back to the Judge to review the fact that while Apple didn't violate a couple of the patents, it may have violate one very important one.

The panel of 6 letting the Judge know that he may have been wrong on his ruling and he needs to look at it again, as they see an issue with it.

In the lawsuit is a patent that wouldn't be FRAND or otherwise available to Apple outside of licensing from Motorola, meaning the may have potentially violated it.

The only reason Apple is wanting to talk now is the fact that Google can take them to court and school them in a very old fashioned way. If these discussions are happening, Apple is scared, they dang well know they violated a patent that is now held by Google. Not just a patent that has to do with looks or which way you swipe a finger, but a technology patent that has been protected for years.

I think what everyone's forgetting is that this isn't a competition to see which companies bigger, the fact that google is a massive company doesn't mean that it will wipe apple in the case, it all comes down to the day, so really there's no point in arguing about this...

The size of a company absolutely plays into a court battle, these battles are won as much in the court room as they are outside of the courtroom. Trials are rigged from the beginning, ever been through the jury selection process? The fact that Google is as massive as it is and has the resources it has makes it a very formidable opponent for Apple, not to mention it now holds a ton of patents that Apple may be in violation of.
