[BGR][AC] Samsung’s plan for revenge: Sue Apple if it dares release an LTE iPhone - Page 31

I don't see them suing over existing tablets. Maybe new ones, but I don't really see why they'd wait for the iPad Mini -- if they can sue because of it then they I think they can sue because of the larger one too.

The definition of copy:

A thing made to be similar or identical to another.

It's pretty damning evidence when one of your biggest competitors thinks Samsung's product is too similar.

It doesn't matter -- fact is Apple is suing Samsung for violating their trade dress, and this evidence came out.

So I did! I fixed it now.

This Sony mockup looks a lot like what eventually became the iPhone 4. Why would APPLE, put a SONY logo on THEIR mockups? I'm SHOCKED. Apple looking at others for inspiration?

The reason it wasn't let into the trial is because Apple didn't copy Sony with the iPhone -- they proved this to the judge by showing the 2005 iPhone prototype:

(Reference: http://www.theverge.com/2012/7/30/3201162/apple-refutes-claim-they-cribbed-notes-from-sony-reveal-prototype.)

As you can clearly see this looks more like the original iPhone and iPhone 4 than the Sony prototype. All they were doing is experimenting with different designs, seeing how they worked and learning from it -- and there isn't anything wrong with that from any company. But they did not try to release it as a final product. And even so this wasn't a copy of an existing Sony smartphone, it was just inspired by Sony and that's a lot different than what Samsung's done.

The whole point which you do not want to comprehend is that Samsung, just like Apple, looked at others for inspiration. It's what companies do. Since Apple has NEVER invented anything, they have been copying and stealing from others to get to where they're at. You're ok with Apple doing this, but it's not ok for Samsung?
There's nothing wrong with looking at others for inspiration -- that's normal business practice, but actually releasing a copy isn't. Of course Apple -- just like every other major company -- has stolen and copied, it's how things are in the business world -- and that's why patents and trade dress exist. So a company can protect themselves from being copied. Perhaps that's why Apple made sure they had so many patents on the iPhone -- so they can protect themselves.

I'm not okay with Samsung copying the iPhone. And I wouldn't be okay if Apple copied Samsung. It is wrong to release a product which is too similar to another product from another company.

2. A 132-page memo showing executives at Samsung saying things like ~"We need to make something like the iPhone" and "Yet when our UX is compared to the unexpected competitor Apple’s iPhone, the difference is truly that of Heaven and Earth. It’s a crisis of design", and "When you compare the 2007 version of the iPhone with our current Omnia, can you honestly say the Omnia is better?"

How is having a 132 page internal memo making comparisons between your product and your competition just soooooooooooo completely different than Apple's comments regarding Sony?
The difference is that Apple didn't release the mockup as a final product. They experimented with designs, which as I said is absolutely fine, but releasing a copy is not. Additionally that document shows clearly that they wanted to make an iPhone-like device, the other document shows that they thoroughly compared the iPhone and Galaxy S and made changes accordingly. And Google's email is pretty damning too.

Yeah and using the definition of copy in that manor, every smartphone is "similar" to the iPhone.

And Samsung could sue them, too; you'll see what the iP5 will look like when it comes out. Oh yes, a SGS 3 rolleyes.gif

SEriosuly.

I mean, every smartphone connects to the internet, is rectangular and performs day to day tasks for us. That's every smartphone ever and that's similar to the iPhone 3G.

No not at all. There's plenty of smartphones which are different or even don't look anything like it.

@Steelbom

Right but they're similar, using that definition. And there are plenty of phones that do look similar to the iPhone but aren't under the bsnhammer.

Well Apple does want to focus its efforts on bigger competitors before going for the smaller ones. Hopefully they'll be sued for anti-competitive measures.

Everyone's just gotta learn to accept that Apple will always come out on top. They will find a way.

Mercedes should sue Lexus for nearly two decades of ugly knockoffs.
