Maybe so, but the fact that this is happening is almost a win in its own right. At least from a public image standpoint.

Apple's "we hope Samsung makes the own phones in the future" statement after their provisional victory can/will be dampened by news that the jury proved to be incompetent/lacking in understanding of their actual duty as jurors both in and outside of the court room.

I dont see how they cant win this appeal, its well documented that the jury were swayed by Hogans understanding of the case, and its also documented that Hogan didnt have a clue what he was talking about with regard to prior art, which IMO was a major factor in the case.

I like how the foreman went on a Q&A on Giz, then people basically started pointing out that he was introducing bias after hearing some of his responses, further biasing the other jurors, and that he was an idiot for doing so on a public posting forum. It was interesting to see a prompt cessation of his responses after that.

I think this is not as clear-cut to prove as it might seem. But it did seem like, from that guy's own description of what went on, he started to profess to the jury like an expert witness, rather than discussing the actual evidence presented. It did seem like decisions were made by the jury based on what this guy (apparently) conveyed based on his own personal opinions as a patent holder.

I just don't understand how the decision of the jury was accepted after discovering cases where devices that were determined to not be infringing were then later assigned infringing-value amounts in the overall verdict. That should be the first thing to go after re. jury issues...

100% invalid bull due to prior art. And just listen to the interview above, he got agressive and wanted to punish Samsung instead of letting them pay out of the patents they broke, and he says himself that "what would I do if I owned patent like this. Would I protect it?" Because of his BS patent, he had MAJOR interest to not let Apple`s patents be invalid due to prior art, because that might put his vague patent in jeopardy. He pursuaded the jury with his "technical background" and basically everyone followed him blindly because of that.
