US Patent 8,180,858 - Filed November 30, 2010.

Admittedly it does reference patents from 2005 and earlier, but still the patent itself was not filed until after these games came out.

Also this patent is so broad that it applies to any game where you choose your character attributes and they are stored in a server. Sound like pretty much every online game with a class based system? It does to me.

So of your two options I would go with number 2: They are patent trolling.

That's my all time favorite mmo also. The game was novel at the time, complex and interesting, and the community was relatively troll free (they all got shunted into Darktide redface.gif). Most of the community built 3'rd party apps (approved of and even encouraged by the devs at Turbine!) eventually became standard features of WoW.

I hope they get some cash from a countersuit.

Good find on the link. Perhaps it should be added to OP to put perspective on this case and help people understand whats actually happening better.
