in other news, not sure why this is a big deal. i don't know anyone who has serious discussions that MS would WANT to listen to on skype. Microsoft is more than welcome to listen in on me playing skype and swearing like a 12 year old sailor on XBOX Live.

Not if it's illegal for them to do so. Sprint can't listen into your phone calls, and Google can't read you e-mail because they are protected(in the US) by the 4th amendment. I don't know if a ruling has been made on VoIP, but I'm fairly confident that it too would be covered for reasons similar to the inclusion of e-mail.
